Welcome to The Next Guide (“TNG”, “we”, “our”, “us”). By accessing our website, using our services, or purchasing any itinerary (free or custom), you agree to these Terms & Conditions (“Terms”). If you do not agree, do not use our services.
1. About Us
The Next Guide provides travel planning services focused on free destination itineraries and tailor-made (custom) itineraries created with input from local specialists. We do not operate tours, accommodations, transportation, or ticketing; we provide planning and recommendations only.
2. Definitions
- “Site”: thenextguide.vercel.app and any related domains/pages.
- “Services”: access to free itineraries, custom itinerary creation, trip messaging, and related content.
- “Free Itinerary”: ungated or publicly available sample plans.
- “Custom Itinerary”: a paid, tailor-made plan prepared for you based on your inputs.
- “Local Specialist”: an individual or partner with on-the-ground knowledge who contributes recommendations.
- “You/Your”: the individual or legal entity using the Services.
- “Third-Party Providers”: external hotels, restaurants, guides, tours, transport, ticketing, insurers, etc.
3. Eligibility
You must be 18+ (or the age of majority in your jurisdiction). You represent that you have legal capacity to enter these Terms and will comply with applicable laws.
4. Account & Access
Certain features may require an account. You are responsible for:
- maintaining account security and confidentiality,
- ensuring your information is accurate and up to date,
- all activity under your account.
We may refuse, suspend, or terminate access for violations or risk/security reasons.
5. Scope of Services
- Planning only: TNG provides curated plans and suggestions. You book and pay providers directly.
- No guarantees: Availability, pricing, hours, access, and quality for Third-Party Providers may change without notice.
- Coverage: We add destinations over time; availability varies by season and staffing.
6. Free Itineraries
- Offered “as is” for inspiration and initial guidance.
- May be updated, edited, or removed at any time.
- Do not include messaging support or revisions.
7. Custom Itineraries (Deliverables & Timeline)
- Intake: You share destination, dates, budget, preferences, travelers, constraints.
- Delivery: Typical turnaround 24–72 hours after receiving complete details; complex trips/peak seasons may take longer (we’ll notify you).
- Format: Mobile-friendly day-by-day schedule with route logic, map links, dining options, and alternatives. Printable version available on request.
- Revisions: Unless stated otherwise, includes 1 round of revisions within 48 hours of delivery (reasonable scope—e.g., swaps, timing fine-tune, alternate dining). Additional revisions may incur a fee.
- In-trip messaging: Reasonable availability for same-day clarifications and lightweight swaps. Extensive re-planning may require an add-on.
8. Pricing & Payment
- Standard fee: USD $85 per Custom Itinerary (1-4) days. Longer durations or multi-city plans may be priced separately.
- Payment: Due in full at checkout via third-party payment processors.
- Taxes/fees: You are responsible for applicable taxes, currency conversion charges, or card fees.
- Price changes: We may change pricing prospectively; posted price at checkout applies to your order.
- Promotions: Coupons or offers are subject to terms, cannot be combined unless stated.
9. Refunds, Cancellations & Satisfaction
We aim for you to love your plan. Because Custom Itineraries are specialized work, please review the policy below (adjust to your operations):
- Before work begins (intake not started): 100% refund.
- After work begins, before first delivery: 50% refund to cover planning time.
- After first delivery: Non-refundable. You may use your included revision(s) within the stated window.
- Quality concerns: If you believe the plan materially deviates from your intake, contact us within 7 days; we’ll reasonably attempt to fix it.
- Processing: Approved refunds are returned to the original method in 7–14 business days.
- Chargebacks: You agree to contact us first to resolve issues. We may dispute chargebacks with evidence of delivery and scope.
10. Your Responsibilities
You agree to:
- Provide accurate, complete trip information (dates, travelers, health/mobility constraints, budget, preferences).
- Review local entry requirements (visas, vaccines), safety advisories, and provider terms.
- Use the Services for personal, non-commercial use.
- Not misuse the Site (e.g., scraping, reverse engineering, spamming, infringing content, or unlawful activity).
11. Third-Party Providers & Affiliate Links
- Bookings are between you and the provider. TNG is not a party to those contracts and is not responsible for provider actions/omissions.
- We may include affiliate links or receive commissions from some recommendations. This never affects the independence of our suggestions.
- Always review provider policies (cancellation, accessibility, safety, insurance).
12. Travel Risks, Visas & Insurance
Travel involves risks (weather, closures, strikes, delays, health/safety incidents). You are responsible for:
- evaluating risks and suitability,
- obtaining visas/permits,
- purchasing comprehensive travel and medical insurance,
- complying with laws and local regulations.
13. Intellectual Property
- The Site, logos, text, graphics, layout, and software are protected by IP laws and owned by TNG or licensors.
- Custom Itinerary license: upon full payment, we grant you a personal, non-transferable, non-exclusive license to use the itinerary for your trip.
- You may not copy, resell, publish, or redistribute our content commercially without written consent.
- User-generated content (e.g., reviews, photos) you submit: you grant TNG a worldwide, royalty-free license to use/display for promotional and operational purposes, subject to our Privacy Policy.
14. Content from Local Specialists
- Local Specialists may contribute content and suggestions. TNG may review, edit, and format itineraries.
- TNG owns the final compiled itinerary as a collective work; you receive the usage license described above.
15. Acceptable Use & Prohibited Conduct
You agree not to:
- circumvent security or access non-public systems;
- scrape, crawl, or bulk-download content;
- use the Services to compete with TNG or build derivative databases;
- infringe IP, defame, harass, or violate others’ rights;
- upload malware, spam, or unlawful content.
We may suspend or terminate accounts for violations.
16. Privacy & Cookies
Your privacy matters. See our Privacy Policy for details on data collection, lawful bases (where applicable), retention, and your rights (e.g., GDPR/CCPA). By using the Services, you consent to our privacy and cookie practices.
17. Disclaimers
- Services and content are provided “as is” and “as available” without warranties of any kind.
- We do not warrant accuracy, availability, or fitness for a particular purpose, nor uninterrupted or error-free operation.
- We do not control Third-Party Providers. Listings, hours, prices, routes, and standards may change. Always verify critical details.
18. Limitation of Liability
To the maximum extent permitted by law, TNG, its owners, affiliates, employees, and partners are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, data, goodwill, or opportunity. TNG’s aggregate liability for claims arising out of or related to the Services shall not exceed the amount you paid to TNG for the relevant Custom Itinerary. Some jurisdictions do not allow certain limitations; rights may vary.
19. Indemnification
You agree to defend, indemnify, and hold harmless TNG and its affiliates from claims, damages, liabilities, costs, and fees (including reasonable attorneys’ fees) arising from: (a) your use of the Services; (b) your breach of these Terms; (c) your violation of laws or third-party rights.
20. Service Changes & Availability
We may modify, suspend, or discontinue any part of the Services at any time, with or without notice. We are not liable for unavailability due to maintenance, outages, or events beyond our control.
21. DMCA / IP Complaints
If you believe content infringes your rights, send a notice to support@thenextguide.com with:
- your contact info,
- description and location (URL) of the infringing material,
- statement of good-faith belief,
- statement under penalty of perjury that you are authorized,
- physical/electronic signature.
We may remove content at our discretion and terminate repeat infringers.
22. Electronic Communications & E-Signatures
By using the Services, you consent to receive electronic communications (emails, in-app messages) and to e-signatures for agreements, receipts, and notices.
23. Governing Law; Venue
These Terms are governed by the laws of Lisbon, Portugal, without regard to conflict-of-law principles.
24. Term & Termination
These Terms apply while you use the Services. We may suspend/terminate access for any breach or risk. On termination, sections that by nature should survive (e.g., IP, disclaimers, liability limits, indemnity) survive.
25. Assignment
You may not assign or transfer rights without our prior written consent. We may assign to an affiliate, successor, or in connection with a merger, sale, or reorganization.
26. Severability; No Waiver
If any provision is unenforceable, the remainder remains in effect. Our failure to enforce a term is not a waiver of the right to enforce it later.
27. Entire Agreement; Order of Precedence
These Terms, plus any order page, policy, or addendum referenced (e.g., Privacy, Cookies, Pricing), form the entire agreement and supersede prior understandings. If there is a conflict, the order page (pricing/scope) controls, then these Terms, then policies.
28. Changes to Terms
We may update these Terms. Changes are effective when posted on the Site with the “Effective Date” above. Continued use after changes means you accept the updated Terms.
